How and why Subscription Boat Club collects, uses, shares and protects your personal information, under the New Zealand Privacy Act 2020.
This Privacy Notice explains how and why we collect, use, share and protect your personal information in our business activities. We handle personal information in accordance with the New Zealand Privacy Act 2020 and its Information Privacy Principles (IPPs).
The agency responsible for your personal information is Windscreamer Boat Club Limited, trading as Subscription Boat Club (hereinafter "SBC", "we" or "us"), located in Auckland, New Zealand. We collect and use personal information for purposes including: managing our membership and customer relationships; verifying identity and boating competency; operating and managing the boats safely; improving our services; marketing; managing business-partner relationships; recruitment; responding to enquiries; social media; cookies and website analytics; and meeting our legal obligations.
We only collect personal information that we need for a lawful purpose connected with our activities, and we tell you why we are collecting it. The main purposes are set out below.
To set up and manage your membership and provide the rental service, we collect and use your contact details, date of birth, a photo or identification, your boating qualifications and boating CV, emergency contact details, and your booking and usage history. We use these to administer bookings, billing and support. The card you register for billing is handled by our payment service provider; we do not store full card numbers.
To keep members and the public safe and to meet our obligations as a rental operator, we verify your identity and your competency to operate a boat - including your Coastguard Day Skipper Certificate (or equivalent) and any boating licence - before and during your membership.
Our boats and mobile app record information about how a boat is used during and after a booking. This includes the boat's location, engine drive time, fuel level and fuel-flow data, hull and engine sensor data, maintenance alerts, and the check-in photos you take of the boat. We use this information for safety, fleet management, fuel reconciliation and billing, incident investigation, and to support trip reporting and overdue-vessel procedures. This aligns with the information described in your Rental Contract.
We analyse customer and usage information to understand how our services are used, to improve them, and to develop new ones. Where we can, we use aggregated or de-identified information for this.
We may send you marketing about our services by email, SMS or post. You can opt out at any time using the unsubscribe link in any message, or by contacting us. We manage electronic marketing in accordance with the Unsolicited Electronic Messages Act 2007.
We process business partners' contact details to manage those relationships; job applicants' contact details, CV information and any other information provided, for recruitment; the contact details and content of anyone who contacts us, to respond to enquiries; and the contact details of people who interact with us on social media, to manage those interactions.
When you visit our website we may collect your IP address and use cookies and similar technologies to operate the site and understand how it is used. You can control cookies through your browser settings.
We collect and keep certain information to meet our legal obligations, including financial, tax and company-record requirements, and maritime safety obligations.
Wherever practicable, we collect personal information directly from you - when you register, complete your boating CV, make a booking, contact us, or use the Service. We also collect information automatically from our boats' systems and the mobile app (as described above), and we may collect information from service providers acting on our behalf (for example, identity-verification or payment providers) and from publicly available sources where relevant.

Where we engage a service provider, we require it to protect your information and to use it only for the purposes for which we engaged it.
Some of our service providers (for example, cloud-hosting and communications providers) may store or process personal information outside New Zealand. Where we disclose personal information overseas, we take reasonable steps, consistent with the Privacy Act 2020, to ensure it is protected by comparable safeguards.
How long we keep your personal information depends on why we collected it. We review what we hold and do not keep it for longer than we need to.
We take reasonable steps to protect personal information against loss, and against unauthorised access, use, modification or disclosure, using technical and organisational safeguards appropriate to the sensitivity of the information.

We will need to be satisfied of your identity before we act on a request, and we will respond within the timeframes required by law. There is generally no charge to access your information, although in some cases a reasonable charge may apply.
If a privacy breach occurs that it is reasonable to believe has caused, or is likely to cause, serious harm, we will notify the affected individuals and the Office of the Privacy Commissioner as required by the Privacy Act 2020.
We may amend this Privacy Notice from time to time - for example, when there is a change in our practices or in the law. Amendments take effect when we post an updated version on our website. If we make significant changes, or significantly change how we use personal information, we will take reasonable steps to notify affected individuals.
